Terms of Service

InsighTeam is currently offered on a limited, early-access basis. Features, availability, and performance may change, and some functionality may be offered as a beta or pilot with limitations we will describe to Customers before production-sensitive data is relied upon.

You must be authorized to act on behalf of the organization you represent to accept these Terms. You are responsible for maintaining the confidentiality of account credentials and for all activity under your account.

Customer is solely responsible for the data it authorizes InsighTeam to ingest and process, including documents, messages, tickets, voice recordings, and WhatsApp communications (“Customer Data”). Customer represents and warrants that it has all rights, consents, and legal bases necessary to provide Customer Data to InsighTeam and to authorize its processing through the Services, including any consents required from end users before enabling call recording or automated messaging.

As between the parties, Customer retains all rights to Customer Data. InsighTeam will use Customer Data only to provide, secure, support, troubleshoot, and improve the Services, as described in our Privacy Policy, unless Customer separately authorizes another use.

You agree not to:

• Use the Services to violate applicable law or the rights of any third party.
• Upload or transmit data you are not authorized to share with InsighTeam.
• Attempt to reverse engineer, disrupt, or gain unauthorized access to the Services or underlying models and infrastructure.
• Use the Services to send unsolicited, deceptive, or abusive messages, including over WhatsApp or voice channels.
• Resell or provide the Services to third parties without our written consent.

The Services use artificial intelligence, including large language models, to generate summaries, insights, transcripts, and automated responses. AI-generated output may be inaccurate or incomplete and should be reviewed before being relied upon for material decisions. InsighTeam does not guarantee the accuracy of AI-generated output.

InsighTeam retains all right, title, and interest in and to the Services, including underlying software, models, and technology. Except for the limited rights granted to access and use the Services, no other rights are granted to Customer.

Each party will protect the other party’s confidential information using at least a reasonable degree of care and will use it only to perform its obligations or exercise its rights under these Terms.

The Services rely on third-party infrastructure and subprocessors, described in our Privacy Policy. Use of certain features, such as WhatsApp Control, is also subject to the applicable third-party platform’s own terms (for example, the WhatsApp Business Platform terms).

Fees, if any, for the Services will be set out in an order form or agreement between InsighTeam and Customer. Services accessed during an early-access, beta, or pilot period may be provided free of charge or at reduced rates as separately agreed.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSIGHTEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Either party may terminate access to the Services as set out in an applicable order form or agreement, or, absent such agreement, with written notice. Upon termination, InsighTeam will handle deletion or return of Customer Data in accordance with our data retention practices and any agreement in place with Customer.

We may update these Terms from time to time. Material changes will be reflected by updating the effective date above, and where appropriate, we will provide additional notice to Customers.
